Subject: European Union prosecution of the Republic of Ireland
(regarding environmental matters).
Dear Ms Wallstrom,
I have read an Internet article today written by The Irish Times
Newspaper which says you will be visiting the Republic of Ireland
on Wednesday.
Although I fully realise that there is not much time available to
you now before your visit, I hope nonetheless that it might
(somehow) be possible for you to have a quick look at the matters
I have raised in a recent petition regarding some local
environmental and heritage problems here in The Republic of
Ireland. The European Parliament petition reference number
in question is: 809/2001.
The main points regarding petition 809/2001 can now be seen at the
www page address immediately below:
http://www.finnachta.com/east-galway/oct-31-2001.htm
Unfortunately, since my last letter to the European Parliament in
connection with petition 809/2001 (dated October 31st 2001), the
local community where I live has suddenly been burdened with an
additional environmental threat. My present understanding of this
new difficulty is that some large international company (possibly
using the local name of Celtic Waste) has recently started to
carry out ground tests in the East Galway area of Kilconnell -
with a view to installing a new superdump for the whole of the
Province of Connacht (which is roughly one-quarter the size of the
Island of Ireland). This particular site (near Kilconnell)
is probably less than one mile (as the crow flies) from a very
important group of heritage sites known collectively as Woodlawn
House. To a number of local people this recent threat
appears particularly bad - partly because some of them have been
working very hard during recent months (doing work for which they
receive no pay) in an effort to have the main Woodlawn House
building restored. Further information on Woodlawn House can be
seen at the following www page address:
http://homepage.eircom.net/~williamfinnerty/wh/index.html
In connection with the paragraph immediately above, it would be
much appreciated if you could take particular note of the fact
that recently enacted legislation here in the Republic of Ireland
(connected with a Waste Management Bill) means that our LOCAL
GOVERNMENT political representatives no longer have any say (as I
understand it) regarding such matters as the location of
superdumps. Many (including myself) believe that if this
particular piece of legislation was tested in our own Courts here
in Ireland, it is very likely that it would be found to be
unconstitutional: not least because of the contents of Item 1 in
Article 28a of the written Constitution of The Republic of
Ireland. For additional information on Article 28A please
see www page location:
http://www.irlgov.ie/taoiseach/publication/constitution/english/government.htm#Local
Government
I would like to take this opportunity to thank the European
Parliament for the letter I received today (dated 22.11.2001)
confirming receipt of my letter of October 31st 2001 (re petition
809/2001). I appreciate this very much.
Although there is not enough time left now for you to receive it
before your trip to Ireland, I nevertheless intend (for future
reference purposes) to send a printed copy of this e-mail to you
through the registered post tomorrow.
Finally, I hope you will have a safe and pleasant trip to Ireland;
and, that your visit will help with regard to the ongoing local
environmental and heritage problems in our very small (and now
somewhat defenceless) rural community here in the eastern part of
County Galway.
Sincerely, Mr. William Finnerty. "St
Albans", New Inn, Ballinasloe, County Galway, Republic of
Ireland.
