Dear Ms Scott, Thank you for your e-mail dated January 20th 2005. I note what you have stated. As I feel that a major misunderstanding has arisen, I would like to make it clear that the main reason, and indeed the only reason, I complained about Dr Foster was because I believed it might enable me to get the medical help I need. I wish to stress that I have no interest whatsoever in
complaining just for the sake of complaining, and even less to make a
career out of complaining.
I am suffering from serious depression; but, after the experience I have had with Dr Foster in Omagh Hospital just before Christmas, I am now afraid to seek help from another doctor because, in the absence of any feedback so far from Mr Mills (Sperrin Lakeland Trust), I fear it may well result in further insults for me: which would undoubtedly make my medical condition worse. I had hoped that when I pointed out the difficulties in my letter to Mr Hugh Mills dated January 11th 2005, copy at http://www.constitutionofireland.com/HughMillsSperrinLakelandTrust.htm , that someone in his department might have picked up on the fact that I urgently need PRACTICAL help, in the very worst of a way, to deal with the growing depression and anxiety I feel regarding the dreadful and extremely stressful situation I have been put into through no fault of my own. I have not done anything wrong, and I have not committed any crime. Basically, and as I made very clear to Dr Foster and his support staff, I am in Northern Ireland at the present time because senior public servants in the Republic of Ireland are attempting to corruptly criminalise me, and possibly imprison me, in connection with a “crime” which they have invented. They are doing this because I have challenged them publicly on the Internet regarding the fact that they have been violating the written constitution of the Republic of Ireland in a number of very important ways for the past several years: and, my evidence relating to these claims is on the Internet for all the world to see: through the www addresses I have already provided you all with. None of all this might be nearly so bad for me if I had a lawyer to defend me, or even to ADVISE me. However, and as I have very clearly explained in my letter to Mr Mills (and to several others including yourself), I am unable to find such a lawyer. By way of further evidence of this fact, please note that I have not received ANY reply to date from Mr Geraghty (who is supposed to be my lawyer) to either of the two letters I sent to him through the registered post on November 30th 2004 and December 21st 2004. and http://www.constitutionofireland.com/FairMurtaghEmail21Dec2004.htm The fact that Mr Geraghty and his several lawyer colleagues at law firm Fair-Murtagh are failing to reply to me regarding the above mentioned two letters speaks for itself: and it should (in my view), at this late stage, represent absolute proof for all concerned that I really am embroiled in a very serious case of political corruption, which has already caused me enormous damage, and where the damage continues to be ongoing for me personally. I fully realise that the size of the corruption problem I am struggling with is so big that there probably is no single government department, in the United Kingdom or in any other jurisdiction, which can provide me with ALL of the practical help I need to satisfactorily deal with my particular issues in the whole matter; and, it is entirely for this reason that I have been copying my e-mails to several different government departments in a number of different jurisdictions. I would also like to make it clear to all concerned that my need for medical help in connection with the depression and anxiety I am at present suffering will very rapidly disappear: if I can find a lawyer who is willing to communicate with me (by e-mail), to advise me, and to defend me against the outrageous psychological abuse I have been subjected to by public servants for several years now, and which is ongoing. With due regard for the statements I have made above, it would be very much appreciated if you and other recipients of this e-mail would please give further consideration to my case: particularly with regard to my very pressing, and my very valid NEED for a lawyer who is willing to communicate with me regarding the legal aspects of my situation. With regard to my request for help in finding a suitable
lawyer who will act in my best interests, I am not asking for a favour; I
am asking to be provided with what is the most basic, and the most
fundamental human right, in law, that I know of. In my email, of the 20 December 2004, a course of action regarding your complaint against Dr Foster and the trust was outlined. I note you have now initiated this procedure. As previously explained, if having used the Health and Personal Social Services Complaints procedure, you remain dissatisfied and believe you have experienced an injustice as a result of maladministration you should contact the Commissioner again asking him to consider your complaint for investigation. You also refer to a 'much larger problem'. Having reviewed your correspondence the only element of your complaint that falls with the jurisdiction of the Commissioner would be the actions of the Trust. The actions of public servants employed within the Republic of Ireland and the actions of solicitors are not subject to the Commissioner's jurisdiction. The above legislation explicitly sets out the bodies and subjects that the Commissioner is able to investigate. I hope this clarifies the Commissioner's position.
