Dear Mr Madden,
I am directed by the Minister for Justice, Equality and Law Reform Mr
Michael McDowell T.D. to refer to your letter of 24 April, 2006 and
previous correspondence on behalf of Mr. William Finnerty, St. Albans,
New Inn, Co. Galway.
Correspondence has now been forwarded to Mr. Finnerty regarding his case
stating that in relation to his "legal difficulties", if he has not
already done so, he may wish to consider consulting his own legal
representative regarding his concerns. The Minister notes that Mr.
Finnerty has had difficulties in securing legal representation.
In relation to Court proceedings, the Minister has informed Mr. Finnerty
that the Courts are subject to the Constitution and the Law, independent
in the exercise of their judicial functions and it is not open to the
Minister to comment or intervene in any way on the conduct or decision
of any individual court case.
The Minister has also informed Mr Finnerty, that operational matters are
a matter for the Gardai, and his correspondence has been forwarded to
them for their information.
