I have not received any reply from you to my letter dated April 27th 2005, which I sent to you through the registered post.

As a direct result of the fact that yourself, Prime Minister Blair MP, and Prime Minister Ahern TD, all appear (to me) to be completely ignoring the contents of my letters of recent months, I have fairly recently found it necessary to seek further medical help to cope with the psychological abuse I am being subjected to (by public servants). Further information on my letters to Mr Blair and Mr Ahern can be found below.

This is the third time I have had to seek medical help since October 2002 regarding this same set of environmental issues; and, I have now spent a total of approximately 12 months in forced-exile regarding the criminal offence I have been charged with, which arose because I shouted at a local government employee who refused to look at an unlawful sewage discharge coming from the primary school situated close to my home in New Inn, County Galway, Republic of Ireland.

As far as I can recall, and with due regard for the fact that my papers relating to the matter are in the Republic of Ireland, and consequently inaccessible to me at the present time (because of the risk of arrest), the criminal offence I have been charged with means I could be imprisoned for up to 18 months.

I feel I should also state here that I am now growing very concerned by the fact that you do not appear to be launching the legal procedure available to you (as EU Commission President) which is referred to as the "infringement procedure" at EU website page address http://europa.eu.int/institutions/comm/index_en.htm (in "Section 3" under the title "Enforcing European law"), even though I have provided you with what I see as irrefutable evidence of EU human-rights law being violated in my case.

It would be much appreciated if you could please, at the very least, advise me in writing as to whether or not you have received the letter I sent to you through the registered post on April 27th 2005.

I hope to be in receipt of your written reply within the coming 14 days please.

The Århus Convention Agreement
 (3 Main Points)

The Århus Convention establishes a number of rights of the public (citizens and their associations) with regard to the environment. Public authorities (at national, regional or local level) are to contribute to allowing these rights to become effective. The Convention provides for:

  1. The right of everyone to receive environmental information that is held by public authorities (“access to environmental information”). This can include information on the state of the environment, but also on policies or measures taken, or on the state of human health and safety where this can be affected by the state of the environment. Citizens are entitled to obtain this information within one month of the request and without having to say why they require it. In addition, public authorities are obliged, under the Convention, to actively disseminate environmental information in their possession;
     

  2. The right to participate from an early stage in environmental decision-making. Arrangements are to be made by public authorities to enable citizens and environmental organisations to comment on, for example, proposals for projects affecting the environment, or plans and programmes relating to the environment, these comments to be taken into due account in decision-making, and information to be provided on the final decisions and the reasons for it (“public participation in environmental decision-making”);
     

  3. The right to challenge, in a court of law, public decisions that have been made without respecting the two aforementioned rights or environmental law in general (“access to justice”).
