Dear Mr Glynn,
I am writing to you
because I strongly believe
Minister for Justice Michael McDowell TD is
perverting the course of justice in connection with the growing set of legal and
financial difficulties I have been struggling with for the past several
years.
Although I am not a lawyer, and although I have long
been finding it impossible to get what I regard as responsible legal help from a
professional lawyer, I nevertheless found the following piece of information on
the internet several weeks ago, and it appears (to me) to be entirely relevant
to my case:
"In English or Irish law,
perversion of the
course of justice is a
criminal offence in which someone
acts in a manner that in some way
prevents justice being served
on either themselves or on a third party. Perverting the course of justice is an
offence in common law. It carries a theoretical maximum sentence of life
imprisonment, although no sentence of more than 10 years has been handed down in

In addition, but only after years of searching (without the
benefit of professional legal help), I eventually found what appears to me to be
the ideal solution for the particular set of legal difficulties I am
experiencing: in the form of
Article 13 ("Right to an effective remedy")
of the Republic of Ireland's "
European Convention on Human Rights Act
2003".
Article 13 of the Act reads as follows:
"
Everyone whose rights and freedoms as set forth in this Convention
are violated shall have an effective remedy before a national authority
notwithstanding that the violation has been committed by persons acting in an

Though I wrote to Minister for Justice McDowell regarding
my "Right to an effective remedy" on
August 4th 2006, he appears to me to
be completely ignoring the entire contents of my letter to him. The text of the

feel I should try to point out, in the strongest possible way, that a large part
of the contents of the letter to Minister for Justice McDowell at the above
address relates to the extremely serious matter of
unconstitutional
legislation, which I believe Minister for Justice McDowell is knowingly
playing a leading role in producing - as evidenced yet again very recently by
the fact that, according to a report on last
Thursday's Irish Independent
Newspaper (i.e. March 29th 2007):
"Justice Minister Michael McDowell was
last night faced with an open revolt by 140 barristers over his controversial
Criminal Justice Bill." The barristers in question obviously realise,
as I have found out to my
EXTREME cost, that they cannot, at
the present time, in any way rely on the parliamentarians to block
unconstitutional legislation, even though it is their duty to do so; and, that
neither can they rely on
President Mary McAleese (our so called
"Guardian of the Constitution") to block it either: in spite of the facts
that
a) she is a lawyer and
b) she
has
first-class legal facilities for checking doubtful and dangerous legislation,
facilities which are deeply embedded in
Bunreacht na hEireann (the
Constitution of the Republic of Ireland), and which cost her nothing to use.
Please note that, as I believe you will already know, the matter of what I (and
others) strongly suspect is unconstitutional legislation has resulted in plans
for two huge rubbish dumps near my home in New Inn, and that one has already
been built (in
Kilconnell). For further information on my efforts to
challenge the highly suspect legislation in question, which only the
Supreme
Court can decide on now regarding its constitutionality (as far as I know),

As Minister for Justice McDowell appears to me
to be acting in a manner that "
prevents justice being served", and as
perverting the course of justice is a
criminal offence, I am
copying this e-mail to
Garda Commissioner Noel Conroy (Chief Commissioner of
Police, Republic of Ireland): in the expectation that, as I understand is
normal practice, the perpetrator of the crime being committed against me will be
brought to justice by the law enforcement agencies, rather than by myself (i.e.
the injured victim).
If for any reason Commissioner Conroy
fails to implement the law relating to "perverting the course of justice",
regarding the manner in which Minister for Justice McDowell is blocking an
"effective remedy" through which I can receive justice, I would then like
your advice on another possible solution to my legal difficulties, which I have
found in a book titled "
Principles of Irish Law" (by Dublin-based
barrister and law-lecturer
Brian Doolan). This relates to the following
statement from his book (on page 9 the Fifth Edition):
"The Supreme Court
decided, in Byrne v Ireland (1972), that the State is a juristic person which
can be sued for the wrongful acts of its public
servants".
In the event that Commissioner
Conroy fails to take significant and meaningful action regarding the ongoing
crime I am being subjected to by Minister for Justice McDowell, I would very
much appreciate it if you could please advise me (in writing) as to how I can go
about suing the State (i.e. Ireland) for the wrongful acts of the public
servants in question. With regard to this possible course of action, I feel I
should stress that a "
To Whom It May Concern" letter from
Dr Michael
McCavert (GP) was sent to Minister for Justice McDowell by a senior social
worker named
Gerard Madden, who has been acting on my behalf for some
time now. As can be seen in the electronic copy of his letter provided at the
address just below, Dr McCavert has diagnosed me as suffering from
"Complex-Post Traumatic Stress Disorder" - which (in his words) is
"the result of traumas and stresses over years and these trauma and stresses
have come at the hands of individuals and public officials and bodies that he
has encountered in his struggles to try to correct environmental wrong

As you may already know, I understand that Mr Madden
(Senior Social Worker) talked on the telephone last Wednesday (i.e. March 28th
2007) with
Greg Nolan (lawyer at your law firm) regarding the possibility
of having a
meeting in Ballinasloe with him, for the purpose of
discussing my case. Unfortunately, it appears Mr Madden eventually decided that
such a meeting would not serve any useful purpose. My understanding of the
overall situation relating to this aspect of things can be found in the e-mail

As I stated in yesterday's e-mail (at the internet
address immediately above), I have now decided to sever all links with your law
firm (Hogan & Co) if you cannot help me regarding the assistance I seek from
you in this letter. In such an event, I would then make a fresh start by
seeking help from other law firms; and, as I trust you will understand, I
believe it would be useful if I was in a position to place the
legal papers
connected with my home in New Inn (County Galway) in the offices of any new
firm of lawyers I might find who are willing to assist me in a significant way -
should it turn out, in your reply to this letter, that your law firm still
cannot (or will not) provide me with such help.
Later
today I will send a printed and signed copy of this e-mail to you through the
registered post.

I feel I should end by stating that (from my
viewpoint) the most irresponsible aspect of the way my case is being handled,
and by far the most difficult for me to cope with, relates to the fact that the
above mentioned "
To Whom It May Concern Letter" from my GP (Dr McCavert)
has so far been completely ignored by so many senior public officials, and for
so long. How those concerned can keep on justifying such complacency and such
inaction, is well beyond my understanding; and, it is for this reason that I
intend to try and make as many voters as possible aware of my unresolved legal
difficulties during the run-up to the "
2007 General Election (Republic of
Ireland)", which I understand is due to take place in a few months time. My
hope is that when everything else I have tried during the past several years, by
way of attempting to get
JUSTICE for myself, all appears to have
completely failed, the manner in which general elections tend to focus peoples'
minds might now somehow help me.
