My questions are:1) Why did the
MEPs (
Members of the
European
Parliament) involved act as though
the matters raised in
Brendan Kelly's Petition dated
February 1st
2002 were of little or no importance? Do they not see anything wrong
with senior "public servants" violating
Article 28A.1 of the written
Constitution of the Republic of Ireland?
Article 28A.1
states:
"The State recognises the role of local government in providing a
forum for the democratic representation of local communities, in exercising and
performing at local level powers and functions conferred by law and in promoting
by its initiatives the interests of such communities."
The text of
Brendan Kelly's petition can be seen at:

The full text of
Bunreacht na hEireann (Constitution of the
Republic of Ireland) can be seen via the following link:

2) Why did the authorities try to corruptly criminalise me (by
unlawful means) because I
tried to draw attention to the Article 28A.1 problem in the run-up to the
May 2002 General Election, when I placed a sign containing an
Internet address by the roadside for the purpose of getting around media
censorship. Further information relating to this issue can
be found at:
http://www.finnachta.com/Election/May_2002_General_Election.htm
3) Why did
An Bord Pleanala completely ignore everything
in the Appeal which I had to pay
EUR 50 to lodge on
February 21st
2004? The text of my Appeal can be seen at:
http://www.finnachta.com/BordPleanalaAppeal.htm As can
be seen at the above address, please note that my Appeal to An Bord Pleanala was copied to
Margot Wallstrom (the then
European Union Environment
Commissioner),
Prime Minister Bertie Ahern T.D.,
Minister for
Justice (Mr. Michael McDowell) T.D., and
Martin Cullen T.D. (the then
Republic of Ireland Minister for the Environment and Local Government).
4) Why
did
Ann Marie Kelly's request for
Legal Aid made on
November 3rd 2004 get rejected when she tried to have the constitutionality of
the alterations (which violate Article 28A.1 of the Constitution) to the
Waste Management Act
checked
by the High Court? The text of her
Legal Aid Application can be seen at:
http://www.annmariekelly.org/LegalAidApplication/3November2004.htm
Please note that checking and correcting unconstitutional legislation
(in the Republic of Ireland) should not be any great problem it seems -
according to the government's own information at the following website:
http://www.oasis.gov.ie/government_in_ireland/the_constitution/unconstitutional_legislation_and_decisions.html
5)
Why is it that
EU Commission President Barroso appears to be
completely ignoring my letters to him regarding the above matters?
Please
note that I have not received any reply so far from him to my letter dated
May 31st 2005 - which I sent to him through the registered
post. The text, and a scanned copy of the Post Office receipt can be seen at:
http://www.constitutionofireland.com/PresidentBarrosoEmail31May2005.htm

I feel I should point out that when all of the above efforts seemed to me
to have failed, I took my case to the
European Court of Human
Rights; and, that in connection with my ECHR Application, I have
recently asked several
Oireachtas Members to discuss my case in
Dail Eireann.
If interested, further information
on this aspect of things can be found at:
