In connection with my case (ECHR
Reference: 25077/05), I would be very grateful to you if you would please
take careful note of the information I have provided
below.
Mindful of your organisation's recent investigations
relating to the United States “extraordinary rendition program", concerning
which the media is referring to the Council of Europe as a "watchdog" for
human rights abuse, please note that in spite of the fact I have been charged
with a criminal offence in 2002, I still cannot find a lawyer to help me to
prepare my legal defence. I feel this is extremely abusive in terms of
my rights under human rights law: especially when I am having to live in
forced exile in the UK to avoid being corruptly criminalised (and possibly
imprisoned) in the Republic of Ireland.
In so far as I can establish, my present
situation is due to the activities of Justice Minister Michael McDowell TD
(Republic of Ireland), and other "public officials" in the Republic of Ireland
(and elsewhere) who are supporting him. As I have mentioned
below, Justice Minister McDowell appears to me to be enthusiastically using the
United States as a role-model for his "public official" duties in the Republic
of Ireland; and, in addition, he also seems to suffer from the delusion that
anybody who challenges him in any kind of major way is a "subversive" - who has
to be severely punished at all costs, and regardless of whether his punishments
are lawful or not. As can easily be seen from a study of Republic of
Ireland newspapers of recent days, I am by no means alone in this view of
Minister McDowell.
I also believe my well-documented European
Court of Human Rights case readily demonstrates the bullying, abusive, and
unlawful tendencies of Minister McDowell (and those who support him). In the
interests of preventing further major human rights violations of the kind I am
being subjected to, I wish you to investigate his very cowardly actions towards
me at your earliest convenience please - particularly in relation to the fact I
cannot find a lawyer, either in the UK or in the Republic of Ireland - who is
willing to help me to legally defend myself. I would ask you to please
note very carefully this last fact leaves me feeling that the shocking situation
relating to rampant corruption in the United States legal profession, as
described by US lawyer Teddy Moore via the Internet link I have provided below,
is by no means restricted to the United States jurisdiction.
I do
hope the Council of Europe has what it takes to investigate human rights
abuses in Western Europe (as well as elsewhere): especially those forms of
abuse such as mine which are very obviously being
vigorously sustained by rampant corruption in the legal
profession here.

I am writing to you because I am experiencing serious
difficulties in connection with several letters sent to public officials,
whereby the contents of the letters in question are not being handled in a
responsible or lawful way.
The most recent incidence of this
long running problem (of several years standing) involves a letter sent on
November 7th 2005 to
Justice
Michael McDowell TD in the Republic of Ireland, scanned copies

The nature of the most pressing difficulties for me
just now, in connection with the latter shown at the above address, have been
outlined in an e-mail I sent earlier today to Mr Gerard Madden (Senior
Psychiatric Social Worker), which I have reproduced below under the text of this
letter, and which I believe are self-explanatory.
Basically,
and for the purpose of explaining the nature of my overall long-term
problem to you, I am being very severely (and illegally) punished by public
officials in the Republic of Ireland, in a manner which seriously violates the
United Nations "CONVENTION AGAINST TORTURE and Other Cruel, Inhuman or Degrading
Treatment or Punishment", and which is happening mainly because of issues
relating to the following two matters:
a) I have been
trying hard for a number of years to protect certain heritage sites in the
Republic of Ireland which I - and indeed many others all over the world -
believe are very important to the Nation, and which are now in great danger of
being completely destroyed or seriously damaged. One of a number of examples of
such heritage sites now under threat (and I could easily provide you with
several more please note) involves some of the ancient monuments in and around
the Hill of Tara area of County Meath, many of which are believed to be very
closely connected with King Ollamh Fodhla and other kings of ancient Ireland.

this last address, and among many other interesting things, King Ollamh Fodhla
is closely linked with the origin of the word "Ulster", and with Brehon Law. By
coincidence, please note there is also a direct link between my family name
("Finnerty") and King Ollamh Fodhla's son who was named King Finnachta, and who
is believed to have reigned over Ireland for the 20 year period between 1277 to
1257 BC. Hardly surprisingly, knowledge of this family-name connection has
heightened my personal interest in this particular set of ancient monuments, and
further historical information relating to this connection can be found at

b) I have been trying to prevent the construction of
two huge rubbish dumps within a mile or so of my home in County Galway, both of
which are unlawful I believe on constitutional grounds (directly
connected with Article 28A.1 of the written Constitution of the Republic of
Ireland). Although I have formally appealed against the first (to be
built) of these two planned dumps (located at Killaghmore, Kilconnell, County
Galway), the five points I raised in my appeal appear to have been completely
ignored by all concerned. Further information relating to the appeal in question

also note that a local young law student named Ann Marie Kelly tried last year
to get Legal Aid to have the constitutionality of the alterations (made around
2001) to the Republic of Ireland's Waste Management Act checked by the High

. Please also note that, according to several reports I am receiving from people
who I know well, in and around the Kilconnell area of County Galway,
construction of this dump is now being rushed ahead at great speed by a company
called Greenstar, which I understand is largely owned by a big company named
National Toll Roads, and which in turn is possibly owned I believe by a still
bigger multi-national company named "Cement Roadstone Holdings". At least
one ancient heritage site appears to have been smashed to smithereens (so far)
at the Kilconnell site by Greenstar; and, local people do not seem to be able to
find out whether or not the destruction in question was carried out lawfully -

I would like to stress that by far the most difficult
of all the practical problems I face just now, is that I remain unable to find a
lawyer willing to advise me properly on any of the matters I am writing to you
about in this letter. As Mr Madden and Dr McCavert will readily confirm to
anybody who needs to know I believe, I have discussed this matter with both of
them many times since last May; and, despite our combined best efforts, we have
so far failed completely to find a lawyer who is willing to act on my behalf and
in my best interests.
Consequently, it would be very
much appreciated if you could take steps to ensure I am provided with the
services of a suitably experienced lawyer who is willing and able to act on my
behalf and in my best interests, as soon as you reasonably can
please.

Thank you very much for your efforts of
yesterday relating to your discussion with Ms Elaine O'Brien in Republic of
Ireland Justice Minister Michael McDowell's office (as described in your e-mail
to me of yesterday).
Unfortunately, and after waiting
patiently for over a month now, I still do not know whether or not Justice
Minister Mc Dowell TD is even aware of the contents of your letter (and Dr
Michael McCavert's letter) to him dated November 7th 2005 - and it is this fact
of not knowing, and not being able to find out for sure, which is causing
the huge build up of pressure in my
brain.
Allowing for all that has happened to me during
my past 12 months of unlawful forced-exile from the Republic of Ireland,
particularly the fact I have been diagnosed as having Complex PTSD, and very
prone to the "explosive anger" symptom of that particular medical condition, if
I was to allow this build-up of negative psychological pressure to keep on
growing in the run up to the lengthy Christmas holiday period just ahead, I
believe it could have extremely serious consequences for me - and possibly for
others as well.
For the purpose of relieving the
mental pressure in question, the first thing I feel I need to do now is to
abandon all hope of Minister McDowell ever helping me; and, from now on, to
think of him strictly as part of the problem, and definitely not as part of the
solution: unless and until such time of course that he himself provides me
with tangible evidence to the contrary.
The second
thing I feel need to do now is to seek assistance from a new potential source of
help, without delay - particularly delays of the kind that are based on
extremely vague, verbal hopes and promises (via third parties) that Minister
McDowell MIGHT help me at some future date - in spite of the fact that he and
his senior colleagues have already completely
ignored many letters I have sent to them through the registered
post over a period of several years. In several cases I have not even
received an acknowledgement of receipt for the registered letters in question -
which I find extremely degrading, in addition to being cruel and inhuman - plus
unlawful I believe.
Consequently, and by way of seeking help
from a potential new source, I now feel I must write to Northern Ireland Justice
Minister David Hanson MP later today.
Please note that
the MAIN purpose of my letter to Minister Hanson (from my viewpoint at this
particular time) is to relieve the painful, dangerous, and worrying build up of
pressure mentioned above (in a lawful way) - which, and although it might not
always have been obvious, is something that I have had to do many, many times in
recent years: as a direct result of all of the ongoing "cruel, inhuman,
degrading treatment and punishment" I have been receiving at the hands of people
such as Minister McDowell and his colleagues.
I will
try and get a few hours sleep now, and I then hope to do a draft of the
letter I plan to send to Minister Hanson later today - which I hope to be able
to let you have an e-mail copy of before 10 am this morning, and which I also
hope we will be able to briefly discuss on the phone before deciding on the
final version.
I still believe it would be better
for you to write to Minister Hanson than I. However, and as I
suspect this could take several days to organise (at a time when I'm under
pressure to try and do something about the "Lisnamult" problems as well),
the TOP PRIORITY for me just now is to deal with the very worrying psychological
pressure that has been building up for me during the past few days - which
I believe is in large part due to the new, powerful, shocking, and very
hard evidence of rampant legal corruption (and rampant plutocracy dressed
up to supply phoney "democracy") provided by United States lawyer Teddy Moore in
his recent video, combined with the new knowledge (for me) of the contents of
the United Nations "CONVENTION AGAINST TORTURE and Other Cruel, Inhuman or

Please note that although I only found out a few days ago
(after a series of long and difficult Internet searches) that the Republic of
Ireland Government had actually ratified the UN Convention Against Torture,
Justice Minister McDowell and his lawyer colleagues in Government have no
doubt known all about this since it entered into force in the Republic of
Ireland on April 11th 2002. I feel these people have got an awful lot
to answer for, and that they may yet live to regret the appalling mental
torture they have knowingly been subjecting me to for the past several years,
and which is ongoing of course: for no good reason whatsoever that I know
of.
Please also note that if you think it might help in any
way, that I have no objections at all to you forwarding this e-mail to anybody
you wish before we discuss the final draft of the letter I plan to send to
Minister Hanson later today.
