"The following four pieces of text have been copied from an article titled "Open Letter to Judge Miriam Malone, President of the District Court", which appeared on Indymedia (Ireland) on September 15th 2007:

"I (Ms Shauna Gillan) am an Irish barrister currently practicing in London."

"I was dismayed to learn that Judge Devins is the wife of a Sligo TD (Member of Parliament) Dr Jimmy Devins (Government Minister) of Fianna Fáil (Main Government Party), the party who made the original deal with Shell and who have a clear continuing interest in protecting the Shell Corporation. A protest against the Government’s contract with Shell is by nature a protest against government policy: a policy which Judge Devins’ husband (at least) supports."

"Her treatment of Mr Reilly (defence lawyer) was extremely discourteous."

"I learn from today’s Irish Times (i.e. September 15th 2005) that Judge Devins has again refused to disqualify herself from another case involving protesters."

"judicial review proceedings" (taken from same Indymedia Article)
by W. Finnerty. Sun Sep 16, 2007 21:11

RUMPOLE (Sep 16, 2007 19:36 above),

Might it be that those (i.e. the individuals involved in the ongoing protest against the Shell Corporation’s exploitation of Irish natural gas resources) with the relevant locus standi know about the bizarre circumstances surrounding the Euros 600,000 legal costs Mr Salafia was saddled with when he sought judicial review proceedings in connection the planned PPP (Public Private Partnership) Toll Road near the Hill of Tara?

Though just about everybody (including the Republic of Ireland's constitutional law expert Dr Gerard Hogan QC) who has carefully examined the matter seems to accept that our "National Monuments (Amendment) Act 2004" is unconstitutional, and in spite of Mr Salafia's attempt to resolve the matter using judicial review proceedings, this Act is STILL being used to damage and destroy some of the Republic of Ireland's most important heritage sites (as far as I know).

For anybody interested, further information on the Euros 600,000 ("judicial review proceedings") disaster referred to above can be found at http://www.indymedia.ie/article/83821#comment204626 .

I find myself wondering if you have any realistic idea - AT ALL - of just how corrupt the legal profession in the Republic of Ireland actually is?

"Since society requires that all its members keep the law, it follows that all members of society should be not only equally bound by, but equally served by, the legal system. Legal rights are after all worthless unless they can be enforced."

(Taken from "English Legal System" by Catherine Elliott and Frances Quinn.)

Too much law, and not enough justice?
